Quotations

All quotations issued by iScan remain valid for thirty (30) calendar days from the date of issue unless otherwise stated in writing. Pricing may be reviewed after this period due to fluctuations in project scope, resource availability, specialized travel requirements, or changing operational costs. A quotation does not constitute a binding transaction or a lock on service schedules until explicitly accepted by the client and confirmed in writing by iScan.

Booking Confirmation

Project bookings and onsite field surveys are formally confirmed inside our scheduling system only after:

  • Explicit written acceptance of the active quotation;
  • Receipt and administrative reconciliation of the stipulated deposit payment; and
  • Issuance of a formal written confirmation notice from iScan. Submitting a project booking request or electronic inquiry through our website does not guarantee operator or equipment availability.

Deposits and payment terms

To secure project scheduling, a commitment deposit must be processed as highlighted on the approved quotation. The final balance account must be settled in full upon completion of site data capture and remains a prerequisite prior to the electronic release of finalized data packages, layout sheets, or live walkthrough assets. iScan operates strictly on a pay-per-project architecture with no mandatory subscription frameworks for historical data access.

Both parties mutually pledge to hold all proprietary project indicators, layouts, and financial metrics in absolute confidentiality, restricting external use unless expressly authorized by the client, dictated by statutory subpoenas, or required for software pipeline compilation.

Furthermore, iScan enforces comprehensive administrative and technical security layers to protect structural records and personal credentials in strict compliance with the Protection of Personal Information Act (POPIA) 4 of 2013. We explicitly acknowledge that under South African law, data protection shields both natural persons and juristic entities (corporate accounts). All coordinates, operational communications, or transaction indices captured during our engagement are processed strictly in accordance with our comprehensive Privacy Policy, which is incorporated into these terms by reference.

PLEASE READ THIS CLAUSE WITH EXTRA ATTENTION. IT PLACES LIMITS ON THE RISK AND REMEDIAL LIABILITY OF ISCAN. IN RIGID COMPLIANCE WITH SECTIONS 49 AND 51 OF THE CONSUMER PROTECTION ACT (CPA) 68 OF 2008, THIS SECTION IS EXPLICITLY HIGHLIGHTED AND BROUGHT TO YOUR NOTIFICATION IN CLEAR LANGUAGE. EXCEPT ONLY IN PROVEN INSIGHTS OF GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR FRAUD INDEPENDENTLY PERPETRATED BY ISCAN OR ITS AUTHORISED SITE AGENTS, ISCAN SHALL NOT ASSUME LIABILITY OR BE HELD ACCOUNTABLE UNDER ANY LAW TO THE FULLEST EXTENT PERMITTED FOR INDIRECT, INCIDENTAL, NOMINAL, SPECIAL, OR CONSEQUENTIAL DAMAGE, LOSS OF PROFITS, OR REVENUE DEVIATIONS ARISEN FROM:

  • DELAYS CAUSED BY UNFAVOURABLE WEATHER CONDITIONS;
  • MUNICIPAL GRID COMPLIANCE FAILURES, POWER OUTAGES, AND LOAD SHEDDING;
  • INTERNET OUTAGES, CLOUD SERVERS DESK INTERRUPTIONS, OR PORTAL OUTAGES;
  • RESTRICTED, CONGESTED, OR UNSAFE PHYSICAL PROPERTY ACCESS PROVIDED BY THE CLIENT;
  • INCORRECT, FAULTY, OR OUTDATED CLIENT-SUPPLIED SITE LAYOUTS AND DOCUMENTATION;
  • ACTS OF GOD AND FORCE MAJEURE EVENTS;
  • THE ACTIONS, DELAYS, OMISSIONS, OR ERRORS OF THIRD-PARTY CONTRACTORS.

OUR TOTAL AGGREGATE FINANCIAL LIABILITY FOR ANY CLAIM, ONSITE FIELD ERROR, OR TECHNICAL DEVIATION IN COMPLETED DRAWINGS DELIVERED SHALL BE PERMANENTLY CAPPED AT THE EXACT MONETARY SUM ACTUALLY TRANSMITTED BY THE CLIENT TO ISCAN FOR THE SPECIFIC SERVICE SEGMENT AFFECTED.

force majeure

Neither party shall be liable for project delivery delays or operational failures caused by circumstances beyond their reasonable control, including but not limited to: natural disasters, floods, structural fires, pandemics, civil unrest, government-enforced restrictions, prolonged municipal power outages, or localized labor disputes.

website use

Users entering our digital domains explicitly agree to interact with web tools in a lawful manner. You are permanently restricted from attempting to compromise core web servers, deploying malicious software or script, utilizing automated scraping crawlers, bypassing firewall parameters, injecting database exploits, or copying website text content and brand assets without prior express written permission.

Governing Law And Resolution Jurisdiction

These Terms and Conditions are governed exclusively by and must be interpreted in rigid alignment with the laws of the Republic of South Africa. Any legal disagreement, transaction challenge, or contractual dispute derived from services with us shall be formally addressed inside the relevant courts holding geographic authority inside South Africa.

fair notice revisions and amendments (cpa compliant)

iscan retains the necessary administrative authority to modify operational guidelines, system packages, technical tiers, and these core Terms and Conditions. To prevent unilateral or unfair policy execution in alignment with CPA Section 48 fairness principles, all active contractual clients will be provided with a fair notification tracking window of thirty (30) calendar days via digital correspondence or a prominent website broadcast before any material update takes effect. Continued interaction with our capture portfolios or survey teams after the notice period represents full consent and agreement with the revised terms.
